Nuvell Website Terms of Use

1. This is an Agreement.
This agreement is between you and Nuvell and its affiliates. This agreement governs your use of Nuvell websites accessible at www.nuvell.com.

Nuvell offers the Nuvell website to you subject to your acceptance of this agreement without change. If you use the Nuvell website, it means you accept this agreement.
 

2. No Warranty.
Nuvell does not (i) warrant or guarantee the accuracy or timeliness of any information available from the Nuvell website; or (ii) make any other warranty with respect to the Nuvell website.

Nuvell provides the Nuvell website "AS IS" and "WITH ALL FAULTS." The entire risk of the quality, performance, and accuracy of the Nuvell website is on you.

Nuvell disclaims all implied warranties of title, merchantability, and fitness for a particular purpose.
 

3. Liability Limitation.
 
Nuvell will not be liable to you for lost profits or any special, incidental, or consequential damages related to this agreement or the Nuvell website.
 

4. Information About You.
You certify that any information that you submit to Nuvell while using the Nuvell website is accurate and complete. You will update us with any changes to this information, if necessary.

Information you submit or Nuvell collects related to your use of the Nuvell website will be handled as described in the Nuvell Online Privacy Policies posted on the Nuvell website.
 

5. Copyright and Trademarks.
The following notices apply to the Nuvell website:

6. Unlawful or Harmful Use of the Nuvell Website.
You will not use the Nuvell website in any way that:
  • Is unlawful;
  • Harms Nuvell;
  • Impairs any Nuvell website (or the networks connected to any Nuvell website); or
  • Interferes with any other party's use and enjoyment of the Nuvell website.
Nuvell has sole discretion to decide whether you have done any of these things.

You will only access or try to access Password protected areas of the Nuvell website if Nuvell provides you a Password giving you access to that area. Otherwise, you will not access or try to access Password protected, secure, or non-public areas of the Nuvell website without Nuvell’s written permission.
 

7. Links to Independent Websites.
Some links provided on the Nuvell website may lead to independent websites. The information presented on those sites is the sole responsibility of those site owners. Nuvell has no control or responsibility for the content of independent websites. Nuvell provides these links to you for your convenience.
 

8. Accessing the Nuvell Website from Outside the United States.
Nuvell intends the Nuvell website to be used primarily by United States residents. The products, programs, and services identified on the Nuvell website may not be available to persons residing outside the United States.
 

9. Other Agreements, Additional Terms, Notices, and Instructions.

This agreement does not change any other agreements between you and Nuvell. If any terms of this agreement conflict with the terms of another agreement between you and Nuvell, then the terms of the other agreement control.

A particular Nuvell website may also contain additional terms or notices that govern the use of that website. If any terms of this agreement conflict with any terms or notices of a particular Nuvell website, then the terms or notices of the particular Nuvell website control.

You agree to review and follow all notices and instructions on the Nuvell website.
 

10. Changes to the Nuvell Website and this Agreement.
Nuvell may change the Nuvell website (including deleting features) in any way, at any time, and for any reason.

Nuvell may change this agreement by posting a revised version of it on the Nuvell website, by posting additional terms elsewhere on the Nuvell website, or through any other method the law permits. You will regularly review this agreement and the Nuvell website for changes or additional terms. If you use the Nuvell website after the effective date of such changes or additional terms, it means you agree to the changes or additional terms.
 

11. Applicable Law.
United States federal law and Arkansas law (excluding choice of law principles) apply to this agreement.
 

12. What Happens if Part of this Agreement is Invalid.
If any part of this agreement is invalid, all other parts stay valid.
 

13. Restricting Access.
Nuvell may suspend your access to all or any part of the Nuvell website at any time and for any reason.
 

14. Ending this Agreement.
Nuvell may end this agreement at any time and for any reason, with or without notice. If this agreement ends, you no longer have the right to use the Nuvell website, but the following sections of this agreement will still apply:
  • Section 2 - No Warranty;
  • Section 3 - Liability Limitation;
  • Section 5 - Copyright and Trademarks;
  • Section 11 - Applicable Law; and
  • Section 12 - What Happens if Part of this Agreement is Invalid.
